Mục 01The current real estate legal framework

Three pillar statutes came into force together on 1 August 2024: the 2024 Land Law (No. 31/2024/QH15), which reforms land valuation, compensation and resettlement, certificates of land-use rights, and the rights of overseas Vietnamese; the 2023 Law on Housing (No. 27/2023/QH15), which recognises and grants certificates to qualifying mini-apartments and tightens social-housing rules (a minimum five-year restriction on resale); and the 2023 Law on Real Estate Business (No. 29/2023/QH15), under which a developer may collect a deposit of no more than 5% of the selling price for future-formed real estate, and only once the property qualifies for sale. What is the maximum deposit for buying future-formed housing?

Under the 2023 Law on Real Estate Business, a developer may collect a deposit of no more than 5% of the selling price, and only once the project qualifies for sale.

Can social housing be resold immediately after purchase?

No. The 2023 Law on Housing imposes a minimum five-year restriction on resale from the date of full payment.
