Vietnam Real Estate Broker Certificate 2026 – Conditions, Dossier and Procedure You Need to Know

Since the 2023 Law on Real Estate Business (Law No. 29/2023/QH15) took effect on 1 August 2024, real estate brokerage has been tightened toward professionalisation. In 2026, the procedure for issuing the broker practising certificate is further standardised under Decree 96/2024/ND-CP and the Ministry of Construction’s Decision 843/QD-BXD. This article helps individual brokers and real estate service enterprises understand the conditions, dossier and procedure.

Mục 01Why brokerage is no longer a “free-lance” activity

Under Article 61 of the 2023 Real Estate Business Law, an individual practising brokerage must meet two conditions simultaneously: (1) hold a broker practising certificate; and (2) practise within an enterprise providing real estate trading-floor services or brokerage services. In other words, individuals may no longer broker independently. The managing enterprise bears responsibility for the broker’s activity, improving transparency and client protection.

Mục 02Conditions and dossier for the certificate

Exam and issuance conditions

An applicant must pass the prescribed examination. The certificate is valid for 5 years from issuance (Decree 96/2024/ND-CP). After expiry, the individual applies for re-issuance.

Exam registration dossier

The dossier includes a registration form with a photo (4x6cm taken within 6 months), a certified copy of ID (citizen ID/passport) and documents per the organiser’s notice. Applicants submit the dossier and fee per the Department of Construction’s notice (in person, by post or online).

Procedure under Decision 843/QD-BXD

From 2 June 2026, the procedures for new issuance, re-issuance and related matters (e.g. trading-floor operating licences) follow Decision 843/QD-BXD. Within 10 working days of the announcement of passing results, the Department of Construction issues the certificate. From 1 March 2026, the certificate carries an identification code for management and look-up.

(1) Ensure brokers hold valid certificates; (2) review the legal status of the trading-floor/brokerage enterprise; (3) standardise brokerage service contracts and internal rules on broker responsibility; (4) track the 5-year validity to renew in time.
